This is a legal agreement between You and the owners of The World in Photos (hereafter called Website or We).

By downloading or uploading photos from this Website you agree that you legally agree to and be bound by all our Terms and Conditions set out below. As a condition of your use of our web site you warrant you will not use our web site for any purpose which is unlawful or prohibited by these terms, conditions and notices.

Terms of Use

This Website contains photos which are uploaded by its members and therefore are protected by International copyright laws. Although we grant You these photos for free the photographers have the right to set certain restrictions upon downloading.

You warrant that You are of legal age to use the Website and to create binding legal obligations for any liability that may incur as a result of your use of the Website. You agree that You are responsible for all of your use of the site including for the use of your account by other parties.

The Website and its members cannot be held liable for any losses or damages resulting from the inaccuracy of any information on the Website.

Uploading Photos

You acknowledge and agree that We have the right to screen the photos You upload to secure they are suitable for distribution. We reserve the rights to remove any inappropriate photos at any time.

By uploading photos on the Website you grant The World in Photos a non-exclusive right to distribute them to third parties for free and according to the Website’s Terms and Conditions. We agree not to sell these photos and not to distribute them outside the Website. We reserve the right to use the photos for promotional purposes on the Website.

You agree that under no circumstances can you demand money from the Website or those using the photos uploaded on the Website by You for the use of the photos. You may ask payment for a higher resolution version of a photo but only if it's not stored on the Website.

You warrant that You own all requisite rights regarding the photos You upload. The World in Photos does not allow the upload of Images that infringe on any copyright, property right, trademark or any other applicable right and therefore can not be held responsible for such issues. In a matter of violation of these Terms and Conditions could result in the termination of this Agreement, the termination of your membership, and possible criminal prosecution.

Downloading Photos

All photos are copyrighted and are the properties of the Website or its photo providers. All rights are reserved unless otherwise granted to You. Your rights to use the photos are subject to this agreement. You acknowledge that downloading a photo does not warrant You an ownership. Your hold is non-transferable, which means that You are not allowed to sell, rent, give, sublicense, or otherwise transfer the photo or its rights for use to a third party.
We hereby grant to You a non-exclusive, non-transferable license to use the photos on the terms and conditions explained in this Agreement free of charge.

You may use the Photos:

On websites, multimedia presentations, broadcast films and videos, cell phones.

In printed promotional materials, magazines, newspapers, books, brochures, flyers, CD/DVD covers, business cards, letterheads, etc.

For decorating your home, office or other public places.

You may not use the Photos:

For pornographic, unlawful or other immoral purposes, for spreading hate or discrimination, or to defame or victimise other people, societies, religions, cultures.

To endorse products and services if it depicts a person.

As part of a trademark, service mark or logo.

In website templates that You intend to sell or distribute. Selling and/or redistribution of the photos are strictly forbidden.

On items such as posters, postcards, t-shirts, mugs, or any similar mass product that would contain the photo in a dominant way.

In any way that could harm the Website’s reputation.

Privacy policy

The World in Photos collects your details for contact purpose only. All details we hold about you will be stored as securely as possible. You will not be sent any 'junk' emails and your details will not be passed to any individual or organisation.

Termination of an account

We reserve the right to terminate your account for any reason that infringe on the Website’s Terms and Conditions.

You have the right to terminate your account any time and for any reason with a written notice and proof of identity. Upon termination We will remove all your photos from the Website.

Links to third parties

This Website may contain links to other websites (Related Websites). We have placed those links for your convenience and information only and, as such, You access them at your own risk. We do not control the content and design of other websites; therefore we take no responsibility for their contents.

General

This agreement shall be governed by the laws of England and Wales. Therefore any English and Welsh court shall have exclusive jurisdiction to adjudicate any dispute which may arise out of the use of this Website.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations, then the invalid or unenforceable provision will be superseded by a valid, enforceable provision which most closely matches the intent of the original provision and in any event the remainder of the agreement shall continue in effect.

Indemnification

You agree to indemnify, defend, and hold harmless The World in Photos and its owners, employees, shareholders, directors and suppliers against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses, arising out of or related to a breach of this Agreement, the use of this site and the use or the inability of use of any photo, your failure to abide by any restriction regarding the use of a photo, or any claim by a third party related to the use of a photo.

Disclaimer

The World in Photos takes all reasonable care to ensure that the information contained on this web site is accurate. We reserve the right to amend the information on this Website (including these terms and conditions) at any time.

However, We can not guarantee the legality of the photos stored in our database and therefore can not be held responsible for any copyright violations.

We offer no warranty, explicit or implied, regarding any photos, or any rights or licenses under this agreement including, without limitation, any implied warranties of merchantability or fitness for a particular purpose. The World in Photos does not represent or warrant that the Website or the photos will meet your requirements or that their use will be uninterrupted or error free.

The World in Photos accept no responsibility and shall not be liable for any damage to, or viruses which may infect your computer equipment or other property by reason of your access to, browsing or use of this Website.

Under no circumstance shall The World in Photos be liable for any damages, losses, injuries or claims or any direct, indirect, incidental, consequential damages of any kind (including but not limited to lost profits, data or savings) howsoever arising (including, but not limited to, as a result of our negligence) in connection with the use of this Website; or the copying or use of any information or material contained in or referred to in this Website; or any failure or delay of the use or inability to use any component of this Website.
